TERMS AND CONDITIONS FOR EXHIBITING WITH TRADE UP NORTH 2022.

1. CONTRACT
By signing the above contract, you have committed your company to exhibiting at the Trade Up North 2022.


2. EXCLUSION OF LIABILITY
The organiser shall not be responsible for any direct, indirect or consequential loss or damage to the stand or other property of any kind brought into the exhibition by the exhibitor, its servants, employees, agents, contractors or invitees or for any injury to the person of an exhibitor, or any of its servants, employees, agents, contractors or invitees howsoever such loss or damage to the stand or property; or
injury to person may be caused and notwithstanding that such loss or damage to the stand or property, or injury to person may have been occasioned by the fault, neglect or gross negligence of the invitees or by exhibition site being in or falling into a detective state of repair. The exhibitor hereby indemnifies the organiser against all and any Actions, claim, demands, costs, charges or expenses arising or resulting directly, or indirectly from any act, omission or negligence by the exhibitor, its servants, agents, contractors or invitees notwithstanding that such action, claim, demand, cost,  charges or expenses may have been occasioned in whole or in part by the fault, neglect or gross negligence by the organiser, its servants, employees, age contractors or invitees, or by the exhibition site or any installations thereof being of failing into a detective state of pair.


3. STAND LIMITATIONS
Exhibition stands will be installed so that they will not extend beyond the space allotted. Any portion of an exhibition stand that obstructs or interferes with the privileges of other exhibitors, or for any reason becomes objectionable at the discretion of Trade Up North, must be immediately modified or removed by the exhibitor.


4. VENUE PROTECTION
Exhibitors will not deface any part of the exhibition facility. Nothing may be posted, nailed, affixed or otherwise attached to any part of the facility. Any costs arising out of negligence on the part of the exhibitor, its agents, or employees will be the sole responsibility of the exhibitor.


5. FLOOR BEARING CAPACITY
Exhibitors may not place objects weighing more than 150kg per square meters unless authorised by the Venue. Any damage caused by excess weight or by the setting up, installation, use, exhibition or removal of any object exceeding this weight will be repaired at the exhibitor’s expense.


6. CARE OF RENTED SPACE
The exhibitor will keep the space occupied by him/her in good order. Exhibitors may not place anything in the aisles during the open hours of the event.


7. ALLOCATION OF SPACE
Space is limited and allocated on a first-come, first-served basis. The exhibition floor plan is tentative and Trade Up North reserves the right to adjust the floor layout.


8. USE OF RENTED SPACE
Trade Up North reserves the right to prohibit any display, which because of noise or other objectionable features, detracts from the general character of the exhibition. Space is assigned to the exhibitors and may not be sublet or reassigned.


9. FREIGHT FORWARDING
All freight deliveries and shipping should be arranged through the official shippers. Trade Up North will not be held responsible for the delivery of materials sent via other agents.


10. FIRE REGULATIONS
Any materials used in the exhibition areas must be non-flammable and meet local fire regulations. The local fire officer has the right to perform an on-site flame test of these materials. Use of any foreign substance, liquid or gas is subject to approval by the Fire Marshall.


11. CONSIDERATION, PAYMENT & SURETY
The consideration recorded on the exhibitor’s application to exhibit shall be payable strictly on the dates agreed, failing which the full amount owing shall become due and payable without notice. If the party signing this agreement on behalf of the exhibitor has not been authorised to do so the exhibitor hereby agrees that in such case its members, directors or partners as the case may be shall be personally liable for all obligations in terms of this contract. Should the Exhibitor be a Company, Close Corporation, Trust, Association or Partnership, then the signatory hereto agrees to bind him/ her as surety for and co-principal debtor with the Exhibitor for all amounts owing by the principal debtor in terms of this Agreement to the Organiser. The Signatory hereto, further hereby renounces the benefits and defences of exclusion and division.


12. CANCELLATION
Cancellations must be received in writing. The 50% deposit on the stand fee will not be refundable after the 25 Feb, 2022 if the exhibitor cancels to cover costs that have been made on the exhibitors behalf.
